Terms & Conditions

Conditions applying to quotations, orders and the use of this site

Quotations
A quotation is valid for the period stated on it, normally 30 days, and is based on the duty, model, voltage, options and quantity it names. Prices assume the delivered flow, pressure, inlet temperature and ambient you supplied; if those change, the selection and the price may change with them. Lead times quoted are estimates given in good faith.

Orders
An order is accepted when HeatX issues an order acknowledgement. The acknowledgement states the model, quantity, price, delivery terms and warranty period, and it governs where it differs from this page or from terms printed on a purchase order. Terms on a purchase order that conflict with these conditions apply only where we have agreed to them in writing.

Selection Information
Equipment is selected against the numbers the purchaser supplies. Where information is incomplete we state the assumptions used and those assumptions form part of the basis of the selection. A dryer selected for 100°F inlet air and a 100°F room is not undersized because the room turned out to be 115°F; confirm the conditions before ordering, or ask us to size for the worst case.

Pricing and Payment
Prices are in US dollars and exclude sales tax, duties, brokerage and freight unless the quotation says otherwise. Payment terms are stated on the acknowledgement; new accounts are normally prepaid or by card, and open terms are available on approved credit. Title passes on payment in full.

Shipping
Shipments are FOB shipping point. Risk of loss transfers to the purchaser when the carrier takes possession, so inspect the crate on arrival and note any damage on the delivery receipt before signing; concealed damage must be reported to us and the carrier within five business days. Freight is prepaid and added to the invoice unless the order names a collect account or the quotation includes it.

Returns and Restocking
Standard stock items may be returned within 30 days of shipment with a return authorization number, unused, in the original packaging, freight prepaid, subject to a restocking charge of up to 25 percent. Special voltages, water-cooled builds, high-pressure and ultra-high-pressure units, anything built or configured to order, and installed filter elements and drains are not returnable.

Cancellations
An order for a stock item may be cancelled without charge before it ships. An order for equipment built or configured to order may be cancelled only with our agreement, and the purchaser is responsible for costs incurred to the date of cancellation, up to the full price where the unit has been built.

Site Content
Ratings, dimensions, correction factors, worked examples and application notes on this site are published in good faith as general reference. Products change, and a unit already in service may have been built to an earlier specification. Nothing on this site replaces a written quotation or the data sheet supplied with a specific unit; confirm anything you intend to design around.

Warranty
Equipment is warranted as stated on the order acknowledgement and summarized on the warranty page. Except as stated there, no other warranty applies, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

Limitation of Liability
Our liability on any order is limited to the remedies in the warranty and in no case exceeds the price paid for the equipment concerned. We are not liable for loss of production, loss of profit, spoiled product, the cost of removing or reinstalling equipment, or any other indirect or consequential loss, however arising. Nothing here limits liability where it cannot lawfully be limited.

Governing Law
These conditions are governed by the laws of the State of California, and the courts of that state have jurisdiction over any dispute arising from them or from equipment supplied under them.
